Cimoszewicz and Harlan v. Wprost
16 March 2012. We have received the opinion of the Warsaw Appellate Court.
The opinion deals with the enforcement of a U.S. judgment in Poland. The plaintiffs were seeking enforcement of punitive damages against one of the magazines in Poland which they sued for defamation.
We have been following the litigation as it involves a unique mix of difficult, unique questions from the area of freedom of speech, law of damages, and international civil procedure. The case might end up at the Supreme Court of Poland.
Courts of the First and Second Instance denied enforcement of the U.S. judgment.
